NY top court says lap dance isn't art, is taxable

(AP) ? Lap dances are taxable because they don't promote culture in a community the way ballet or other artistic endeavors do, New York's highest court concluded Tuesday in a sharply divided ruling.

The court split 4-3, with the dissenting judges saying there's no distinction in state law between "highbrow dance and lowbrow dance," so the case raises "significant constitutional problems."

The lawsuit was filed by Nite Moves in suburban Albany, which was arguing fees for admission to the strip club and for private dances are exempt from sales taxes.

The court majority said taxes apply to many entertainment venues, such as amusement parks and sporting events. It ruled the club has failed to prove it qualifies for the exemption for "dramatic or musical arts performances" that was adopted by the Legislature "with the evident purpose of promoting cultural and artistic performances in local communities."

In the dissent, Judge Robert Smith wrote that it was a question of what the law and regulations actually say. The law defines a "dramatic or musical arts admission charge" for "a live dramatic, choreographic or musical performance," he noted. Choreography means dance, and clearly the women at Nite Moves dance, he wrote.

"The majority implies that since the Legislature did not exclude from the entertainment tax other lowbrow forms of entertainment, such as baseball games and animal acts ... it would not have wanted to exclude pole dancing; but the issue is not what the Legislature would have wanted to do, but what it did," Smith wrote. Chief Judge Jonathan Lippman and Judge Susan Read agreed.

Smith added that while he finds this sort of dancing "unedifying ? indeed, I am stuffy enough to find it distasteful," discriminating on the basis of content such as imposing a tax on Hustler magazine and giving the New Yorker an exemption "would surely be unconstitutional. It is not clear to me why the discrimination that the majority approves in this case stands on any firmer constitutional footing."

The New York State Department of Taxation and Finance has said all along the exemption didn't qualify in this situation, spokesman Cary Ziter said. "We're pleased with this decision, because it gives similar businesses clear guidance on the issue of sales tax when it comes to live exotic dance establishments."

Nite Moves was originally assessed $124,000 in sales tax due plus interest, Ziter said. The department was unaware of similar cases working their way through the courts, he said.

Calls to the club's attorney W. Anderson McCullough were not immediately returned.

In a dig-out, hunters take shovels and dig into the ground until they?re deep enough to reach the fox. A dog is then dropped into the hole where the two animals tear at each other. Foxes are not the only victims in this situation, as dogs usually sustain heavy injuries themselves. The fox is then removed from the hole and fed to the hounds. Any fox unattainable with a dog is dragged out with a pole wrapped in barbed wire.

The third and final most problematic practice is that of live hare coursing. Hares are set loose within wired enclosures and are then hunted down by dogs until they are killed. Dogs here too sustain injuries. All three of these activities are legal in Ireland.

However, Ireland?s animal laws are now being updated with the revision of the Animal Welfare Bill. Confusion in Libya over fate of former Gaddafi spokesman

TRIPOLI (Reuters) - Libyan militias captured Muammar Gaddafi's chief spokesman on Saturday, the government said, but an audio clip posted on Facebook purporting to be the voice of Moussa Ibrahim denied his capture.

There was no independent verification of the authenticity or timing of the Facebook post, dated October 20, a year to the day after the dictator's death.

A statement from the prime minister's office said Ibrahim, who was the mouthpiece of the Gaddafi regime during last year's war, was caught in the town of Tarhouna, 70 km (40 miles) south of Tripoli.

"He is being transferred to Tripoli to begin interrogation," the statement said.

The government has previously made false claims regarding the capture of Gaddafi loyalists, and produced no photographs on Saturday showing Ibrahim in detention.

His whereabouts have been unknown since the fall of the capital in August 2011. The government claimed to have caught him last October but he called Reuters to deny the report.

Libya's new rulers have led the nation to elections but have struggled to impose their authority on a country awash with weapons. Leader Mohammed Magarief said some areas of the country still needed to be fully "liberated".

In the Facebook clip, a voice sounding like Ibrahim's said: "I am addressing you a year after the martyrdom of the great leader and his free companions and the fall of the legitimate free nation of Libya under NATO's bombings and their criminal allies.

"About the news of my arrest ... and the spreading of this news in the media, this is just to divert attention from the crimes that are being committed by NATO allies."

The voice on the recording said Ibrahim, who held regular press conferences in the luxury Tripoli hotel were journalists stayed during last year's war, was no longer in Libya.

Former rebel fighters have maintained Gaddafi loyalists have used the town of Bani Walid, some 160 km (100 miles) south of Tripoli, as a safe haven, protected by the large Warfala tribe which has historically been loyal to Gaddafi's tribe.

Speaking on television late on Friday about the insecurity still plaguing parts of Libya, national congress leader Magarief singled out Bani Walid which has seen deadly clashes in the last few days as the army struggles to impose order.

"The campaign to liberate the country has not been fully completed," Magarief said.

He cited "delays" in the formation of the army and police and the failure to disarm and integrate former rebels.

"This lack of care has led to the spread of chaos that has lured the old regime to infiltrate the country's institutions inside and to conspire with the regime loyalists on the outside," Magarief said.

"And the chaos has lured others to kidnappings, stealing, and to create non-legitimate prisons. What has happened in Bani Walid in the last few days falls under this...it has become a safe haven for a large number of those who are outside of the law."

Militias, aligned with the Defence Ministry, have shelled the hilltop town of 70,000 for several days. A spokesman for the Bani Walid militia Colonel Salem al-Wa'er said fighting continued again on Saturday.

The Libyan state news agency LANA said the number of deaths in the clashes reached 14, with 200 people injured.

GRIEVANCES

Many of the militia members are from the rival town of Misrata, which was enraged by the death of rebel fighter Omran Shaban after two months in detention in Bani Walid.

Shaban, from Misrata, was the man who found Gaddafi hiding in a drain pipe in Sirte on October 20, 2011.

Libya's congress ordered the Defence and Interior Ministries to find those responsible for abducting Shaban and suspected of torturing him to death. It gave Bani Walid a deadline to hand them over. The army chief of staff said on Thursday the army was heading to the town to try and restore order.

"This is not targeting a region, a tribe, or unarmed civilians but outlawed men," Magarief said.

Tensions between Misrata and Bani Walid underscore the challenge Libya's new rulers face in reconciling groups with long-running grievances.

While Misrata spent weeks under siege by Gaddafi forces in last year's war, Bani Walid was one of the towns that remained loyal to Gaddafi longest.

It remains isolated from the rest of Libya and former rebels say it still harbours pockets of support for the old government.

? Rose Garden. Located between the Residence and the West Wing, the Rose Garden was built by First Lady Ellen Wilson and redesigned by JFK in 1961. When weather is nice, the President?s bill signings, press conferences, and diplomatic functions take place in the Garden.

The self-guided tours are free to the public, but a ticket is required for everyone. National Park Service distributes free, timed tickets at the Ellipse Visitor Pavilion at 15th and E streets, beginning at 8 AM throughout the day of the tour. This Friday, October 19, and Saturday, October 20, will be the last days of the 2012 fall garden tours.

NEW YORK (Reuters) - JPMorgan Chase & Co apologized to the U.S. energy regulator on Thursday for providing misleading information about California electricity markets, saying it was inadvertent.

The bank also urged the U.S. Federal Energy Regulatory Commission not to follow through on a threat to suspend its market-based rate authority, which would force it to sell power at a significantly lower rate and probably would drive it out of the market.

The regulator has said the bank broke the law by submitting misleading information to the commission and the California grid operator.

The commission's latest probe comes on the heels of a separate lawsuit, in which it has accused JPMorgan of bidding up electricity prices in California and the U.S. Midwest.

JPMorgan said any omission of facts was inadvertent and contended that it should not be penalized with revocation of its ability to profitably trade in electricity markets.

"...we respectfully submit that suspension of (J.P. Morgan Ventures Energy Corp's) market-based rate authority is not an appropriate or proportionate response," the bank said.

It attached four affidavits in the response, two from lawyers and two from bank employees, that verify it had considered all statements accurate at the time it had submitted them, it says.

FERC had issued the "show cause" order on September 20 to the JPMorgan unit, giving it 21 days to show why it should not be found to have violated the Federal Power Act.

FERC spokesman Craig Cano said the agency will consider the response but did not provide a timeline for its decision.

A JPMorgan spokeswoman did not immediately return a request for comment.

In the 69-page response released by FERC on Thursday, the bank said it "regrets and apologizes for its failure to address the FERC communications in certain submissions."

This order is also the latest in FERC's investigation into banks it believes to be manipulating electricity markets.

Last month, FERC asked Deutsche Bank Energy Trading LLC to prove that it did not manipulate California Energy markets or face a $1.5 million penalty.

In April, FERC alleged that Barclays Plc bid up California power prices between November 2006 and December 2008.

In March, the agency won a record $245 million fine from Constellation Energy over charges of power market manipulation.

Excavating The Extension Use Case


Additionally, it seems to me that a condition associated with an extension point must also ?belong to? the base use case and not to the extend relationship between the extension use case and the base use case as in the example shown in Figure 16.3 of [2]. In terms of this example, how can the ?customer selected HELP? condition arise unless the base use case accommodates it to arise? After all, the base use case describes how, in pursuit of a certain goal, the initiating actor can interact with the system to which the base use case belongs. Actually, I see no need for an ?extension condition? when you name an extension point after the condition that has arisen in the base use case at the extension point.

Actually, an extension point should never be named after an action that is assumed to be performed at the extension point (i.e., by an extension use case), because as part 1 of this article explained, the base use case doesn?t know whether it?s being extended at a given extension point, let alone by which extension use case!

Extension use cases without and with actor involvement

In Jacobson?s example cited in part 1 of this article, the base use case?s initiating actor is unaware of the extension use case, because the extension use case doesn?t require the actor?s involvement. However, there are also extension use cases that do involve the actor. This is fine, as long as the goal of the extension use case is perpendicular to that of the base use case, and the extension use case doesn?t require any of the base use case?s private data. This is illustrated in the following diagram.

After the ?Log In? base use case reaches the ?User has been authenticated? extension point, the ?Advertise Product? extension use case is given control. The extension use case determines whether, during one of its previous executions, the user chose or declined to be informed about the product. If not, the user chooses one of the following options, which causes the extension use case to take the corresponding action.

The extension use case then ends and control returns to the base use case.

This behavior can be modeled as an extension use case because its goal in no way contributes to the base use case?s goal, it requires none of the base use case?s private (local) data (e.g., User Password, Security Questions and Answers) and the data it does require has been defined as public (global) data (i.e., User Id).

This extension use case controls an interaction between the system and the base use case?s initiating actor in pursuit of the ?Advertise Product? goal of the off-stage stakeholder that is perpendicular to the ?Log In? goal of the on-stage stakeholder.

Extension use cases vis-?-vis event-driven architecture (EDA)

Part 1 of this article noted that an extension use case intersects with a base use case at a single condition or event in the base use case. While this is an event-based relationship, an extend relationship is not suited to represent an event-driven relationship as understood in event-driven architecture because it fails to meet at least the following EDA principles described in [3].

Reports current events: A publisher use case is modeled to produce an event object that represents an event as it happens or a condition as it is detected. Mediated by an event manager, the event object triggers one or more subscriber use cases that are modeled to consume the event object.

  • A base use case doesn?t produce an event object, so it?s not a publisher.
  • An extension use case is neither triggered by nor consumes an event object, so it?s not a subscriber.

Late or no binding: An event publisher and event subscriber are not aware of each other?s identities when they are developed or deployed.

  • While a base use case is unaware of an extension use case, an extension use case is aware of the base use case and its extension point from the moment the extension use case is modeled because it owns the relationship with the base use case.

Moreover, the relationship between a publisher and a subscriber use case is asynchronous (the latter doesn?t execute as part of the former), whereas the relationship between an extension use case and a base use case is synchronous (the former executes as part of the latter).

My first article [4] outlines an approach for modeling publisher and subscriber use cases that requires neither extension use cases nor inclusion use cases.

Misapplications

Now that I view the extension use case this way, several of its widely advocated uses strike me as misapplications or anti-patterns. These include using an extension use case to represent the following.

  1. Optional behavior that contributes to the goal of the base use case?s initiating actor. This category includes Cockburn?s examples mentioned in part 1 of this article. For example, ?Check spelling? is a mini goal toward the ?Edit document? goal in the eyes of the initiating actor.
  1. Behavior that accesses data in the base use case. For example, not only does ?Check spelling? read the document being edited in the base use case, it may also update that document by making spelling corrections to it.
  1. Behavior that belongs to a base use case whose specification is locked, or base use case behavior that will be added in a later release. Here, using an extension use case is driven by circumstances surrounding the delivery of a system, not by the nature of that system. That doesn?t seem to be the point of representing a system?s functional requirements as use cases.

Rather than model such behavior as an extension use case, add it to the base use case, where it can access the use case?s private data, if necessary. By the way, if you don?t like ?alternative flow? to label purely optional/non-essential behavior, which isn?t an alternative to any other behavior, consider using ?neutral flow? instead.

This way, all the behavior related to the initiating actor?s goal is brought together in one use case rather than spread across several use cases. Your readers will appreciate that.

One outcome of these findings and consequences is that opportunities to use the extension use case construct are relatively few, as befits its specialized nature.

To extend or not to extend

Finally, the following decision table shows how I currently decide whether or not to use an extension use case to model behavior that doesn?t correspond to a complete actor-initiated use case.

(*) If/when there is a convention for declaring certain of a base use case?s private data as publicly accessible at an extension point, model the behavior as an extension use case.

(**) This implies that the behavior?s goal contributes in some way to the base use case?s goal in the eyes of the use case?s initiating actor.

In conclusion

This ?archeological dig? made me understand the extension use case more clearly than before and replaced vague subjectivity on when it might be used with clear objectivity on when it ought to be used. I hope this article does the same for you.

The term ?base use case? only applies in the context of a use case relationship (e.g., in the context of an extend relationship, it refers to the extended use case). For ease of reference, I have used the term here also to refer to a ?candidate? base use case, even when, after further consideration, it doesn?t end up being an extended use case.

Family shocked at Bangladeshi's arrest in NY plot

DHAKA, Bangladesh (AP) ? A Bangladeshi man accused of trying to bomb the Federal Reserve building in New York City is a banker's son from a middle class neighborhood whose family members said Thursday that they were stunned by his arrest.

The FBI arrested 21-year-old Quazi Mohammad Rezwanul Ahsan Nafis on Wednesday after he tried to detonate a fake 1,000-pound (454-kilogram) car bomb, according to a criminal complaint.

Prosecutors said Nafis traveled to the U.S. on a student visa in January to carry out an attack.

His family said Thursday that Nafis was incapable of such actions.

"My son can't do it," his father, Quazi Ahsanullah, said as he wept in his home in the Jatrabari neighborhood in north Dhaka.

"He is very gentle and devoted to his studies," he said, pointing to Nafis' time at the private North South University in Dhaka.

However, Belal Ahmed, a spokesman for the university, said Nafis was a terrible student who was put on probation and threatened with expulsion if he didn't bring his grades up. Nafis eventually just stopped coming to school, Ahmed said.

Ahsanullah said his son convinced him to send him to America to study, arguing that with a U.S. degree he had a better chance at success in Bangladesh.

"I spent all my savings to send him to America," he said.

He called on the government to "get my son back home."

Bangladesh does not have the same record of involvement in global terror as Pakistan, with which it once formed a nation before winning its independence in 1971. At least one Bangladeshi was among those detained by the U.S. at Guantanamo Bay Naval Base in Cuba.

It's the latest snapshot of the growing burden of student?debt?and it's another discouraging one: Two-thirds of the national?college?class of 2011 finished school with loan?debt, and those who borrowed walked off the graduation stage owing on average $26,600 ? up about 5 percent from the class before.

The latest figures are calculated in a report out Thursday by the California-based Institute for?College?Access and Success (TICAS) and likely underestimate the problem in some ways because they don't include most graduates of for-profit?colleges, who typically borrow more than their counterparts elsewhere.

Still, while 2011?college?graduates faced an unemployment rate of 8.8 percent in 2011, even those with?debt remained generally better off than those without a degree. The report emphasized research showing that the economic returns on?college?degrees remain, in general, strong. It noted the unemployment rate for those with only a high school credential last year was 19.1 percent.

"In these tough times, a?college?degree is still your best bet for getting a job and decent pay," said TICAS President Lauren Asher. "But, as?debt?levels rise, fear of loans can prevent students from getting the education they need to succeed. Students and parents need to know that, even at similar looking schools,debt?levels can be wildly different. And, if they do need to borrow to get through school, federal student loans, with options like income-based repayment, are the safest way to go."

The latest figures come at a time of increasing alarm about the sheer scope of student?debt?nationally, which by some measures has surpassed $1 trillion. Recent government figures show nearly 10 percent of borrowers of federal student loans in the most recently measured cohort had already defaulted within two years of starting repayment.

The issue has come up on the presidential campaign trail, though the candidates' specific plans haven't become a major issue. President Barack Obama has touted his record of ending $60 billion in subsidies to private lenders, directing the savings to student aid and implementing an income-based repayment plan that caps federal student loan payments at 15 percent of income and forgives repayment after 25 years.

Former Massachusetts Gov. Mitt Romney, his Republican challenger, argues the flood of federal student aid spending unleashed in recent years has led?colleges?to raise tuition prices. He wants to return to a system in which the government supports private lenders, arguing it's more cost-effective, and his campaign has called the income-based repayment program flawed.

In Tuesday night's second presidential debate, Romney repeated an assertion he'd made previously that "50 percent of kids coming out of?college?(are) not able to get work." That is not accurate, though twice earlier in the debate he made an important qualification, indicating he was referring to graduates who couldn't get "college-level jobs." Figures analyzed by Northeastern University's Center for Labor Market studies last spring did find 53.6 percent of bachelor's degree holders under age 25 were either unemployed or working in positions that don't fully use their skills or knowledge.

The latest TICAS report also cites studies that found more than one-third of recent graduates were in positions that did not require a degree, depressing wages, though other government figures cited by Georgetown University's Center on Education and the Workforce put the so-called "underemployment" rate for young college?grads much lower ? at around 10 percent.

As for those who have no job at all, according to Georgetown the latest monthly unemployment figure forcollege?graduates under age 24 is 10.5 percent (the figure typically jumps each spring as a new class graduates and declines over the course of the year; last March it was 5.4 percent).

"Increasing student?debt?in a weak economy can be a knock-out blow to many considering?college," said Rich Williams, higher education advocate with U.S. Public Interest Research Group, which advocates for students. "As our economy is recovering, lawmakers must send every signal that?college?is a good investment. "

Among other finding in the TICAS report:

?Private (non-federal) student loans, which generally have weaker borrower protections but have been diminishing as a source of student borrowing, accounted for about one-fifth of the?debt?owed by the Class of 2011.

?Debt levels vary widely by state, ranging from $17,250 in Utah to $32,450 in New Hampshire.

?Debt at individual schools ranged from $3,000 to $55,250 though not all schools report that data.

?Among?colleges, the percentage of graduates with?debt?ranged from 12 percent to 100 percent. At 64 schools, more than 90 percent of student graduated with?debt.

A Golf Cart Has Many Alternative Uses

The golf cart has long proven very convenient on the golf course for a very long time. However, a golf course is not the only venue that can benefit from the four-wheeled, open-air vehicles. Golf carts could be a way to improve the level of fun at your favorite recreation spots.

Anyone who has hit the greens before knows that a golf bag can be a heavy, but they are necessary part of the game. Fortunately, the vast majority of courses in this country offer carts that can be rented by the round and make transportation of the burdensome bags much more manageable. However, these carts have begun to serve many other purposes in recent decades, as the market has found a wide variety of needs could be met with the simplistic motor vehicle.

Outdoor sports

The great outdoors offers numerous options for fun and adventure, but it certainly can be wide open. Traditional golf carts can easily maneuver through the backyard along nearby trails or to and from neighboring properties when visits are requested. They can be further customized for additional seating or built to act as more of a golf beer cart, keeping refreshments cold and easy at hand.

On the Farm

Hobby farmers will delight at the ease of getting around, from pasture to barn and back, while hauling hay, feed, or even an injured pet. Golf carts, as mentioned above, are much quieter than many of the All Terrain Vehicles on the market, so there is less risk of frightening skittish animals, as well.

Large Party Transport

Are you entertaining at a park or other large grounds? Mobile hospitality carts can make guests more comfortable as they move from parking lot to entertainment site, as also as they mingle with friends or family. This type of service can also be very favorable at hotel pools and entertainment venues as well, where guests appreciate drinks and food coming to them. Golf beverage carts can be made just to carry the goods or adapted to cart people as well.

Bence Hajdu's Abandoned Paintings: Hungarian Artist Turns Classic ...

A Hungarian artist recently took classic paintings by Old Masters like Leonardo da Vinci and Sandro Botticelli and turning them into eerie snapshots of Renaissance-era ghost towns.

It's part of a series titled "Abandoned Paintings," which is an impressive project undertaken by fine art student Bence Hajdu. Using a little modern technology, he takes famous scenes from "The Last Supper" to "The Annunciation" and transforms them into haunting spaces by erasing the characters and figures that populate the frames. What's left is an architectural wasteland that remains vaguely familiar to any art history amateur. Scroll down for more images.

Hajdu explained his creative retouching process to Designboom: "At one of [my] descriptive geometry classes, we had a task to find and draw the perspective and horizon lines of renaissance and other pictures with significant perspective space. I thought it is not that interesting to just draw lines, so I decided to erase all the characters from them and examine how the painter really created the perspective space and how it actually looks."

We like the idea, posed by our friends at Hyperallergic, that these vacant images be used for a highbrow video game targeted toward the art-inclined gamers of the world. "Call of Easel: Modern Artfare" or "Grand Theft Fresco: Venice," perhaps?

Russia's Putin sacks member of Medvedev's cabinet

MOSCOW (Reuters) - Russian President Vladimir Putin sacked a member of Prime Minister Dmitry Medvedev's cabinet on Wednesday after five months in office, asserting his authority over a government some analysts predict will be short-lived.

Putin signed a decree dismissing Regional Development Minister Oleg Govorun, one of two ministers he had publicly criticized last month, and replacing him with Igor Slyunyayev, a former governor of Kostroma region northeast of Moscow.

The Kremlin has dismissed suggestions that Putin was unhappy with the government, but his criticism of the two ministers added to speculation that he could dismiss Medvedev's cabinet, particularly if economic conditions worsen.

It was the first change in the cabinet Putin unveiled two weeks after his May 7 inauguration to a new presidential term after consultations with Medvedev, the protege who served as president during Putin's four-year stint as prime minister.

The decree gave no reason for the dismissal and Putin made no mention of Govorun in a meeting with Slyunyayev.

He told Slyunyayev he had been recommended by Medvedev, in line with protocol, but the move emphasized that Putin holds ultimate authority.

Russia's paramount leader since his initial 2000-2008 presidency, Putin has sometimes used sackings to keep subordinates in line and maintain balance between rival Kremlin factions.

Putin had singled out Govorun and the labor minister for criticism at a budget meeting a month ago. He suggested they had failed to implement decrees he issued upon taking office and urged Medvedev, who was not present, to reprimand them.

He also said the cabinet's draft three-year spending plan had failed to cover his commitments.

Analysts had said after the meeting that Putin was laying the groundwork for the potential dismissal of the government, especially if economic conditions worsened.

Putin told the new minister to pay particular attention to moving Russians out of the dangerously decrepit housing that is a common cause of complaint in far-flung regions, where Putin draws strong support as city-dwellers tire of his 12-year rule.

The Regional Development Ministry oversees housing and utility development programs in the regions, seen as crucial to securing popular loyalty in the course of Putin's six-year term.

First Indication that Treasury is Serious about Student Loans Being ...

In discussions with many students, I get the sense that the prevailing thinking seems to be that the government will "do something" to eliminate the student loan burden. Not so fast.

The Treasury has no money to bailout the loans and the banksters will want to get paid. I can see riots and protests down the road on the issue, but for now, the Treasury has fired its first shot indicating that those holding student loans should get serious about paying the loans back.

?The Treasury, the D2D Fund, and Center for Financial Services Innovation today announced the winners of the App Design portion of the MyMoneyAppUp Challenge?a contest offering cash prizes and recognition for the best mobile app ideas and designs "to help Americans make smart financial choices, access high quality financial products and services, and ultimately control and shape their financial futures."

So was the winner someone who came up with a way to balance personal budgets, track banking accounts, etc.? Not quite.

It's almost comedic, but the Grand Prize, "for making smart financial choices" app, ?went to Nicole Kendrot, who designed MoneyApp: Z. From the Treasury release:

z helps to make student loans easy and simple to manage. ?Among other features, the app allows users to: ?link information about all of their student loans in one place; create a payoff plan that syncs with their budget; suggest ways the user can reduce their payment period and total interest paid by making extra payments; learn about managing student loans; and test their knowledge about student loans and personal finance.

National Democrats investing in Ariz. Senate race

WASHINGTON (AP) ? National Democrats are boosting their investment in Arizona's Senate race to replace retiring Sen. Jon Kyl, another sign that the race between Republican Jeff Flake and Democrat Richard Carmona is competitive.

The Democratic Senatorial Campaign Committee says it is purchasing $526,000 in air time over the coming six days in Arizona. That comes on top of about $500,000 the committee has already dedicated to the race.

Federal Election Commission records indicate that a super PAC affiliated with the tea party movement, Freedom Works for America, has also started to weigh into the race. It's spent more than $200,000 over the past two weeks on signs, online ads and other activities designed to help Flake.

Republicans have a distinct advantage in Arizona with no Democrat holding statewide office.
